CARVEXA General Terms & Conditions

The baseline rules that apply to everyone using the CARVEXA marketplace.

Draft — prepared by CARVEXA for review by a qualified South African legal practitioner. It outlines our intended approach and must not be relied on as final legal advice until reviewed.

1. About these terms

These General Terms & Conditions apply to every person who uses CARVEXA, whether as a buyer, private seller, independent seller, dealership, organisation, auction participant or visitor. More specific terms (Independent Seller Terms, Organisation Terms, Dealership Terms, Vehicle Listing Rules, Auction Terms, Buyer Terms and the Seller Authorisation Agreement) apply in addition to, not instead of, these terms.

2. What CARVEXA is — and is not

CARVEXA provides a marketplace, technology platform, verification services, communication tools and transaction workflows. CARVEXA is not the owner, seller, dealer, auctioneer of record or guarantor of any vehicle listed on the platform, unless explicitly stated in writing for a specific transaction.

Verification statuses describe what CARVEXA has checked. No verification is a guarantee of a vehicle's condition, ownership, legality or fitness for any purpose.

3. Three-way responsibility model

  • CARVEXA is responsible for: the marketplace, technology, verification processes and communication/transaction workflows it provides.
  • The dealership or organisation is responsible for: vehicle ownership and authority to sell, accuracy of vehicle information, authorising its representatives, pricing decisions, sales approval, required legal documentation, delivery/handover and applicable warranties.
  • The independent seller is responsible for: accurate representation, using only authorised information, not misrepresenting their authority, not collecting unauthorised payments, not changing vehicle information without permission, following organisation instructions, protecting customer information and following CARVEXA's rules.

4. Your account

You must be legally capable of contracting, provide accurate information, keep your credentials secure and use only one account unless CARVEXA permits otherwise. Businesses must register with their true legal identity.

5. Prohibited conduct

  • Misrepresenting ownership, authority, a vehicle's condition or a verification status.
  • Instructing buyers to pay into personal accounts outside an approved CARVEXA transaction workflow, or accepting cash/deposits on behalf of an organisation without authority.
  • Listing stolen, encumbered-without-disclosure, unsafe or legally restricted vehicles.
  • Impersonating CARVEXA, a dealership, an organisation or another user.
  • Circumventing CARVEXA transaction, payment or safety controls.

6. Suspension and termination

CARVEXA may suspend or terminate access where these terms are breached, where a listing creates legal or safety risk, or where required by law. Verified statuses may be removed where they were obtained through inaccurate information.

7. Liability

CARVEXA provides the platform on an 'as is' basis. To the maximum extent permitted by South African law, CARVEXA is not liable for losses arising from vehicle condition, ownership disputes, payment arrangements made outside approved workflows, or conduct between users. Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008.

8. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Please first raise complaints with CARVEXA via ask@carvexa.co.za; unresolved disputes may be referred to the relevant ombud or court.
